(PC-CII) Conducting Internal Investigations
(HALF DAY PM)

Fred Rivera, Partner, Perkins Coie

Companies have gradually concluded that internal investigations are an effective tool to proactively discover and correct misconduct. A strong and equitable internal investigation function, coupled with a corporate culture that allows individuals to "raise their hand" when they witness misconduct, ideally situates a company to deal with difficult situations caused by inappropriate activity. At the same time, developing and managing an investigation program, that works, is rife with unique challenges.

This half-day workshop will include practical advice and discussion of:

  • How to start and continuously improve an internal investigation function:
    • Creating effective policies and procedures
    • "Hotlines" and other intake methods
    • Organizing and managing an investigation
    • Retaining an investigation team
  • "Nuts and bolts" of conducting internal investigations:
    • Using outside counsel and experts
    • Dealing with sensitive matters
    • Legal considerations
    • Computer forensic evidence gathering
    • Interview techniques
    • Final reports and decision making
